Berrys Bay Marina, a member of the Meridien Group, has lodged with North Sydney Council a DA for a massive marina development of Berrys Bay covering over 50% more water area than ever leased in the Bay.
This proposal would have a major impact on Sydney Harbour and Berrys Bay and on residents of Lavender Bay, Union and Waverton Precincts. It would undermine the quiet charm of this treasured recreational area enjoyed by the people of Sydney and visitors.
For over two decades Waverton Precinct and others have worked hard with North Sydney Council on the former industrial lands on Waverton Peninsula. We have won back the magnificent Carradah Park, formerly the BP Site, and the enormously successful Coal Loader Centre.
We have actively encouraged appropriate scale development of the waterfront industrial land in Berrys Bay. However any redevelopment must be consistent with the iconic status of Berrys Bay as Sydney Harbour foreshore and part of the natural and heritage status of Waverton Peninsula.
We believe the massive over-development proposed will undermine the values of the rare and scenic Waverton Peninsula.

- Read the DA in detail on North Sydney Council’s website DA Tracker under 260/2015 or 10/2015/260. A model is on display at Council offices.
- Attend the major public meeting being convened by Waverton Precinct to provide detailed information to the public and assist in submissions which close on 7th September.
- The Public Meeting will be on the open space across the road from the Coal Loader on 30th August at 11 am. Before and after the meeting Waverton Precinct members will be available to walk with people around the site and to provide more detailed information.

- Public assets do not defend themselves. It is crucial that as many members of the public as possible lodge submissions opposing this overdevelopment.
The DA will be reviewed by North Sydney Council but will be determined by a Joint Regional Planning Panel following the conclusion of the exhibition and submission period.

The DA has gone “live” from 7th August 2015 and will close on the 7th September 2015. It’s number is D260/2015.
The full development application and the accompanying documents including the environmental impact statement can be inspected at the North Sydey Council Chambers between 9.00am and 5.00pm Monday to Friday. Also the North Sydney Council’s website www.northsydney.nsw.gov.au provides access to plans showing external elements of the proposal and supporting documentation via the website’s DA tracking system
Development Application 135/2015 was lodged with North Sydney Council on 6 May 2015 by Berry’s Bay Marina Pty Ltd, and loaded onto Council’s website. However, on 14 May 2015 Council inserted a new line into the Application Details on the website – “Determined: 14/05/2015 Cancelled”. We understand the DA has been rejected by Council because of technical non-compliance and requires amendment before re-lodging. We do not know how long that process may take. There is no mention of this lodgement and cancellation on the developer’s website http://talkberrysbay.com.au/ .

In a letter to Waverton residents dated 23 March 2015 local Member Jillian Skinner writes: “RMS advises that the DA will be lodged in April as a 3D model of the proposed development required by North Sydney Council is still being made”.
As far as we know Pacifica Developments have still not lodged the Development Application for assessment by North Sydney Council officers on behalf of the Joint Regional Planning Panel. Precinct has not received any update from the developer’s Community Liaison Manager since her email of 3rd December 2014 (see below).
Precinct has written to Duncan Gay, Minister for Ports & Freight, pointing out the failure of RMS to properly observe the conditions which it should have followed to mitigate environmental impacts of its recent partial demolition of the western wharf and the eastern T-wharf in Berrys Bay. RMS appears to have failed in its fundamental duty to protect the marine environment of this highly sensitive site. Precinct has requested a guarantee that RMS will ensure that the conditions of the applicable Review of Environmental Factors will be properly observed in the demolition and removal of the remaining on-water structures.

Precinct representatives at a Waverton Peninsula Working Group meeting on 14 October 2014 learnt that RMS had now given the green light permitting the developer to lodge its Development Application (DA) with Council, and that the developer was now expected to lodge the DA within 4 to 5 weeks. This indicates DA lodgement in mid-November, which would result in the DA public consultation and submission period spanning the Xmas/New Year holiday season.
From RMS we learnt that the DA proposal would include a super yacht facility on the dolphin wharf for 13 super yachts (up to 40 metres long), which would be linked to Woodleys Cove by an access way capable of carrying motorised vehicles to provision the super yachts. In Woodleys Cove there would be 71 boats in marina berths on-water, and between 38 and 60 boats in dry stack in the Woodleys shed/on trailers within the bund wall car park. This indicates that all up there would be in excess of 140 boats parked at the Berrys Bay marina.
When Precinct representatives met with the RMS Principal Manager, Property on 10 October they were told that the developer is expected to lodge its Development Application with Council in 2 to 3 weeks time.
In our letter we warn the Premier Mike Baird that his Government’s agency RMS has told Precinct that they are about to issue consent to the developer to lodge a Development Application for the Berrys Bay marina which we argue fails to protect the unique values of Sydney Harbour. We therefore request the Premier’s urgent intervention to assert the primacy of the Harbour planning instruments, to reset his Government’s commercial goals from the development, and to direct the developer to revise its proposals to work within those parameters.
